Terms of Service
for the SaaS platform 3D Prints (3d-prints.app)
1. Scope
These General Terms and Conditions (GTC) govern the contractual relationship between RuM Agentur GmbH, Rümikerstrasse 64, 8409 Winterthur, Switzerland (hereinafter "Provider"), and its customers (hereinafter "Customer") regarding the use of the Software-as-a-Service platform "3D Prints" at 3d-prints.app (hereinafter "Platform" or "Service").
By registering or using the Platform, the Customer fully accepts these GTC.
2. Service Description
The Platform enables customers to create 3D product configurators and embed them on their own websites. The scope of services depends on the subscription plan chosen by the Customer. The Provider makes the Platform available as a web-based application and is responsible for its operation and maintenance.
3. Contract Conclusion and Registration
A contract is concluded when the Customer completes the registration process and the Provider confirms the subscription. The Customer undertakes to provide truthful and complete information during registration and to keep this information up to date.
4. Trial Period
The Provider may offer a free trial period. During the trial, the Customer has access to the full functionality of the chosen plan. After the trial expires, the subscription is automatically converted to a paid subscription unless the Customer cancels before expiry.
5. Prices and Payment
Current prices are available on the Provider's website. All prices are exclusive of statutory value-added tax (VAT) unless otherwise stated.
Billing occurs in advance according to the chosen billing period (monthly or annually) via the payment processor Stripe. The Customer authorizes the Provider to automatically charge the due amounts to the stored payment method.
In case of failed payment, the Provider reserves the right to restrict or suspend access to the Platform after a reasonable grace period.
6. Term and Cancellation
The subscription renews automatically for the respective billing period unless cancelled before the end of the current term.
Cancellation can be made at any time via the Customer's dashboard or by email to info@3d-prints.app. Cancellation takes effect at the end of the current billing period. Amounts already paid are not refunded.
7. Plan Changes
The Customer may adjust their subscription at any time via the dashboard (upgrade or downgrade). Price changes are prorated for the current billing period.
8. Availability and Maintenance
The Provider strives for the highest possible availability of the Platform but does not guarantee 100% uptime. Planned maintenance will be announced in advance where possible. The Provider is not liable for outages caused by force majeure, technical failures of third parties, or other circumstances beyond the Provider's control.
9. Customer Data and Content
The Customer retains all rights to uploaded content (3D models, images, texts, configurations). The Provider receives a non-exclusive right of use insofar as necessary for providing the Service.
The Customer is responsible for ensuring that their content does not infringe third-party rights and does not violate applicable law.
The retention period for user data (e.g. designs, configurations) depends on the chosen subscription. After expiry of the subscription or retention period, the Provider may delete the data.
10. Customer Obligations
The Customer undertakes to:
- keep access credentials confidential and protect them from third-party access;
- not misuse the Platform or impair its functionality;
- not upload illegal, offensive, or harmful content;
- provide all necessary information in a timely and complete manner.
11. Liability
The Provider's liability is limited to intent and gross negligence. Liability for indirect damages, consequential damages, lost profits, or data loss is excluded to the extent permitted by law.
The Provider's liability is in any case limited to the amount paid by the Customer in the last 12 months.
12. Data Protection
The Provider commits to the confidential treatment of personal data in accordance with the Swiss Data Protection Act (nDSG) and the European GDPR where applicable. For more information, see our <a href="/en/privacy" class="text-sky-600 hover:underline dark:text-sky-400">Privacy Policy</a>.
13. Intellectual Property
All rights to the Platform, including software, design, trademarks, and documentation, remain with the Provider. The Customer receives a non-exclusive, non-transferable right of use for the duration of the subscription.
14. Changes to GTC
The Provider reserves the right to amend these GTC at any time. Changes will be communicated to the Customer in a timely manner (e.g. by email or notice on the Platform). Amended GTC are deemed accepted unless the Customer objects within 30 days of notification. In case of objection, the Provider has the right to terminate the contract at the end of the current billing period.
15. Applicable Law and Jurisdiction
These GTC are governed by Swiss law, excluding conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is Winterthur, Switzerland.
16. Severability
Should individual provisions of these GTC be invalid or incomplete, the remaining provisions shall remain unaffected. In place of invalid or missing provisions, a provision shall apply that comes closest to the economic purpose of the original provision.
